This Acceptable Use and Fair Usage Policy (“AUP”) applies to your use of the AI Call Agent platform and related services (the “Service”) provided by [COMPANY LEGAL NAME] (“we,” “us,” or “our”). It forms part of your agreement with us (Terms of Service and EULA). Violation may result in suspension or termination of your account.
1. Minimum Age and Eligibility
- You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service.
- Recommended minimum signup age: 18. The Service is intended for business use; binding contracts and consent in many jurisdictions require users to be adults. We do not knowingly allow users under 18 to create accounts.
2. Prohibited Uses – Calling Agents
You must not use the Service (including AI calling agents) for any of the following:
2.1 Clearly Prohibited Categories
- Dating, romance, or escort services – The Service may not be used to solicit or conduct dating, romance, or escort-related calls or campaigns.
- Gambling, betting, or games of chance – The Service may not be used to promote, facilitate, or conduct gambling or betting activities.
- Illegal activities – You may not use the Service for any purpose that violates applicable law, including fraud, money laundering, terrorism financing, or other criminal activity.
- Harmful or abusive content – No harassment, bullying, threats, hate speech, or content that promotes violence or discrimination.
- Deceptive or misleading use – You may not use the Service to impersonate another person or entity, or to mislead call recipients about the nature of the call (e.g. claiming to be a human when the caller is an AI—our system discloses AI use; you must not circumvent this).
- Spam and unsolicited contact – You must have appropriate consent (or another lawful basis) before placing outbound calls where required by law (e.g. TCPA, GDPR). You must honour Do-Not-Call and opt-out requests.
- Circumvention of security or limits – No bypassing of call caps, spending limits, or technical safeguards we put in place (e.g. max call duration, country blocks, DTMF verification).
2.2 Other Restricted Uses
We may also prohibit or restrict:
- Adult or explicit content – Use for adult entertainment or sexually explicit solicitations.
- Weapons, drugs, or controlled substances – Promotion or sale where illegal or in violation of our policies.
- Pyramid or Ponzi schemes – Multi-level marketing or similar schemes that we determine to be abusive or illegal.
- High-risk financial services – Where we determine that use poses regulatory or reputational risk (e.g. certain crypto or payday lending campaigns).
- Any use that could harm our infrastructure, partners, or other users – Including excessive or abusive traffic, attempts to probe or attack our systems, or use that violates our telephony or AI partners’ policies.
We reserve the right to add or clarify prohibited categories and to restrict use on a case-by-case basis.
3. Fair Usage
- Reasonable business use: The Service is intended for legitimate business use (e.g. lead qualification, appointment booking, customer contact in compliance with law). We expect usage to be consistent with normal business practice.
- Call duration and volume: We may apply technical and commercial limits (e.g. maximum call duration, caps on concurrent calls, spending alerts) to protect the platform and control cost and abuse. You must not circumvent these limits.
- Credits and billing: Use of credits and billing must comply with our Billing & Refund Policy. Abuse (e.g. fraudulent top-ups, chargebacks in bad faith) may result in suspension or termination.
- Data and contacts: You must only upload or use contact data for which you have a lawful basis and, where required, consent. Scraping, buying lists without proper consent, or using data in breach of privacy laws is prohibited.
If we determine that your use is excessive, abusive, or inconsistent with fair usage, we may throttle, suspend, or terminate your access and may refuse to refund unused credits.
4. Enforcement
- We may monitor and investigate use to ensure compliance with this AUP and applicable law.
- We may remove content, suspend or terminate accounts, report activity to authorities, and take other action we deem necessary.
- You are responsible for the use of your account and for ensuring that anyone using the Service on your behalf (e.g. employees, contractors) complies with this AUP.
5. Changes
We may update this AUP from time to time. We will notify you of material changes (e.g. by email or in-app notice). Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service.
